On July 21st, 2022, the Building Industry Association of Greater Chicago (BIAGC), in conjunction with the Home Builders Association of Illinois (HBAI), will host a special webinar to discuss the impact of HB5412 and HB4600 that were signed into law by Governor JB Pritzker on June 10th.
The wage theft measure, House Bill 5412, was a significant initiative of the Mid-America Carpenters’ Regional Council, which allows a worker with a wage theft or fringe benefit grievance against a subcontractor to sue the primary contractor to rectify the situation. The bill was opposed by the Home Builders Association of Illinois, BIAGC, and other home builder associations around the state.
Among other opponents were minority subcontractor groups, including the Hispanic American Construction Industry Association, the Black Contractors Owners and Executives, and the Federation of Women Contractors. They argued that the measure was a union attempt to drive up the cost of non-union labor.
While HB5412 exempts union projects, homeowners who act as general contractors, and government projects, HB4600 added exemptions for renovation or repairs to existing residential structures, projects under $20,000, and work on a single unit of a multi-family building. HB4600 also created the Bond Reform in the Construction Industry Task Force.
